These terms cover your use of theherdagency.com. The Herd Agency is a brand of Film Sheep LLC, a Pennsylvania limited liability company in the United States. In these terms, “The Herd,” “we,” and “us” mean Film Sheep LLC. Using this site means you agree to what follows. If you do not agree, do not use the site.
This site is marketing material. It describes our creative strategy and creative production services, shows examples of our work, and offers tools such as the Ad Diagnostic. Everything on it is informational. Nothing on it is a binding offer, a guarantee of results, or professional advice. We plan and produce creative for paid advertising. We do not run ads, buy media, or manage ad accounts.
If you hire us, a separate written agreement governs that work. It sets out scope, fees, deliverables, timelines, confidentiality, and ownership. Where that agreement and these terms disagree about the engagement, the agreement controls. These terms still govern your use of this website.
The Ad Diagnostic is a self-assessment tool. It gives you a general read based on the answers you select. It is not an audit, a forecast, or advice specific to your business, and we do not review your accounts to produce it. Any results file you download is yours to keep and to use at your own judgment.
The contents of this site belong to us or to our clients and licensors. That includes text, layout, graphics, logos, video, photography, and sample creative. Client work appears here as portfolio, with permission. You may not copy, republish, distribute, or make derivative works from any of it without our written permission. Quoting a short passage with a link back is fine.
Clients own the creative we deliver to them, on the terms set out in their agreement with us. We keep the right to show that work in our portfolio and in our own marketing, including on this site, unless the agreement says otherwise. Nothing on this site changes what a signed agreement says.
Use the site for what it is for. Do not attempt to gain unauthorized access, interfere with how it runs, scrape it at scale, submit false information through our forms, or use it for anything unlawful. We may restrict access if you do.
This site links to and embeds services we do not control, including video hosting, scheduling, and analytics. Those services operate under their own terms and privacy policies, which apply when you use them. We are not responsible for their content or their practices.
This site is provided as is and as available, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise that the site will be uninterrupted, error free, or accurate at every moment. Work shown here was made for specific brands in specific conditions. It does not predict what any other brand will get.
To the fullest extent the law allows, Film Sheep LLC and its members, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of this site, including lost profits, lost revenue, or lost data. Where liability cannot be excluded, our total liability for any claim connected to this site is limited to the amount you paid us in the twelve months before the claim arose. Some states do not allow these exclusions or limitations, so parts of this section may not apply to you.
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law rules. Any dispute about this site or these terms belongs in the state or federal courts located in Pennsylvania, and both sides agree to that.
We may update these terms. The date at the top of this page shows the current version. If you keep using the site after a change, you accept the updated terms.
