This policy explains what theherdagency.com collects, why, and what you can ask us to do about it. The Herd Agency is a brand of Film Sheep LLC, a Pennsylvania limited liability company in the United States. In this policy, “The Herd,” “we,” and “us” mean Film Sheep LLC. We plan and produce creative for paid advertising. We do not run ads, buy media, or manage ad accounts. Using this site means you accept what is described here.
What you give us. The contact form asks for your name, work email address, company website, and how many new ad concepts you put out in a month. The Ad Diagnostic collects the answers you select, and your downloadable results file is built from them. We also keep whatever you send us by email, by booking a call, or as a shared file.
What we collect automatically. As you browse we log your IP address, browser type and version, the pages you view, the date and time of your visit, how long you spend on each page, the referring URL, and similar diagnostic data.
To reply to you and to do the creative strategy and production work you ask for.
To follow up on an inquiry, a scheduled call, or a project already underway.
To build your Ad Diagnostic results and, if you asked us to, to talk them through with you.
To run, maintain, secure, and improve this website.
To understand how the site is used so we can make it better.
To detect and prevent fraud, spam, and misuse, and to meet our legal, tax, and accounting obligations.
Access that clients give us is for research only. Clients grant access to accounts and inboxes so we can read the things that show how their customers talk: reviews, competitor reviews, ad comments, support tickets, and sales calls. Clients also share their own acquisition targets and P&L guardrails. We treat all of it as confidential, we use it only for that client's work, and access can be withdrawn at any time. We do not run ads, buy media, manage ad accounts, or build the pages people land on. You keep the media, the accounts, and the schedule.
We do not sell, rent, or trade your personal information. We share it with service providers who help us operate this site and run the business, and only the information they need to do that job. Those providers fall into a few categories: website hosting and infrastructure, analytics, email and scheduling, file storage and project management, and accounting and professional advice. We may also disclose information when the law requires it, when we need to protect our rights, safety, or property, or if the business is sold or reorganized. Donations connected to our Give a Sheep pledge go to Heifer International directly. We do not collect, process, or store donation or payment information.
This site uses cookies and similar technologies. There are a few kinds:

We keep personal information only as long as we need it for the purposes in this policy, or as long as the law requires. Inquiry and diagnostic records are kept while a conversation is active or likely, and for a reasonable period after that. Client project records are kept for the life of the engagement, and for as long as we need them for legal, tax, and accounting reasons. When information is no longer needed we delete it, or strip out anything that identifies you.
You can ask us for a copy of what we hold about you, ask us to correct it, or ask us to delete it. Depending on where you live, you may also be able to object to how we use it, ask us to restrict it, or ask for it in a portable format. You can stop marketing email at any time by using the unsubscribe link or by replying and telling us. Email kyle@theherdagency.com to make any of these requests. We will respond within the time applicable law allows.
We use reasonable administrative and technical safeguards, and we limit access to the people who need it. We are based in the United States, so the information we hold is stored and processed there. No method of transmission or storage over the internet is completely secure, so we cannot promise absolute security.
This site is for businesses, not children. It is not directed to anyone under 13, and we do not knowingly collect personal information from children. If you think a child has sent us information, email us and we will delete it.
We may update this policy. When we do, we will change the effective date at the bottom of this page. If you keep using the site after that, you accept the updated version.
